General Terms and Conditions
§1 Scope
These General Terms and Conditions (hereinafter "T&C") apply to all contracts concluded between Florian Bodewei (hereinafter "Provider") and the customer concerning the digital artworks offered on this website (hereinafter "Products"). Deviating conditions of the customer are not recognised unless the Provider expressly agrees to their validity in writing.
§2 Contracting Parties and Formation of Contract
(1) The Provider is:

(2) The presentation of Products on this website does not constitute a binding offer but an invitation to submit an offer (invitatio ad offerendum). The contract is formed when the customer selects the Product via the Gumroad platform, completes the purchase process in full, and payment confirmation is issued by Gumroad.
(3) The Provider does not store the contract text. After purchase, the customer receives a confirmation e-mail from Gumroad containing the relevant purchase details.
§3 Digital Products and Rights of Use
(1) The Products offered are digital artworks in the form of image files (e.g. JPEG, PNG). After successful purchase, Products are made available for download via the Gumroad platform.
(2) Upon purchase, the customer acquires a simple, non-transferable licence for the exclusively private and non-commercial use of the purchased work.
(3) Without the express prior written consent of the Provider, the following are in particular not permitted:
- reproduction or distribution to third parties
- commercial use of any kind
- public display or dissemination
- modification, adaptation, or incorporation into other works
- offering for download or resale
§4 Prices and Payment
(1) All stated prices are final prices in euros. As the Provider is exempt from VAT as a small business pursuant to §19 UStG (German VAT Act), no VAT is shown and none is payable.
(2) Payment processing is handled exclusively via the Gumroad platform (Gumroad, Inc., 548 Market St, San Francisco, CA 94104, USA). The payment methods available there apply (including credit card, PayPal). The Provider does not operate the payment platform and assumes no responsibility for its availability or any payment issues.
§5 Delivery of Digital Content
(1) Digital Products are made available for download via the Gumroad platform immediately after successful payment. The customer receives a download link to the e-mail address provided at the time of purchase.
(2) The Provider assumes no liability for technical disruptions or interruptions in delivery by the Gumroad platform that are beyond the Provider's control.
(3) As these are digital goods, no physical delivery takes place. Costs for data transmission or device use are borne by the customer.
§6 Right of Withdrawal
(1) Consumers are generally entitled to a statutory right of withdrawal of 14 days.
(2) The right of withdrawal expires prematurely pursuant to §356 para. 5 BGB (German Civil Code) if the Provider has begun performance of the contract and the consumer has expressly agreed, prior to commencement of performance, that the Provider may begin performance before the withdrawal period expires, and has confirmed that they forfeit their right of withdrawal upon commencement of performance by giving such consent.
(3) The relevant consent and confirmation is obtained during the purchase process via Gumroad. Upon completion of the purchase and immediate access to the file, the right of withdrawal expires.
§7 Copyright
All works contained on this website and in the files offered for download are protected by copyright. The copyright is held exclusively by Florian Bodewei. Any reproduction, distribution, public communication, commercial use, or modification requires the prior express written consent of the author. Infringement of these rights may result in civil and criminal consequences.
§8 Liability
(1) The Provider is liable without limitation for damages caused by intentional or grossly negligent conduct, as well as for damages arising from injury to life, body, or health.
(2) Otherwise, the Provider's liability for slightly negligent breaches of duty is excluded, unless these relate to material contractual obligations (cardinal obligations). In the event of a slightly negligent breach of cardinal obligations, liability is limited to the foreseeable, contract-typical damage.
(3) The Provider does not guarantee that the digital content is suitable for the purpose intended by the customer or is compatible with specific devices, operating systems, or software applications.
§9 Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr/
§10 Final Provisions
(1) The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) The place of jurisdiction for merchants, legal entities under public law, and special funds under public law is Berlin.
(3) Should individual provisions of these T&C be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be deemed replaced by one that comes closest to the economic purpose of the invalid provision.
